We have an opening for a Patent Counsel in the Lawrence Livermore National Laboratory (LLNL) Office of General Counsel. The successful applicant will assume a leadership role in working with management, peers and other professional staff on multi-disciplinary teams in order to address legal and business matters that are both diverse and multi-faceted in scope and that may potentially have a significant financial or reputational impact on Laboratory programs or operations. You will provide legal advice to Laboratory management and staff regarding intellectual property law, with emphasis on filing and prosecuting patent applications and coordinating with outside counsel who prepare and prosecute patent applications for the Laboratory. The position requires subject matter proficiency in one or more of the following fields: biology; optics, lasers, physics, computer science; chemistry and materials; mechanical, chemical or electrical engineering.

Essential Duties

- Prepare and prosecute US and foreign patent applications, in a variety of technical fields.

- Manage the work of outside patent counsel who prepare and prosecute patent applications for the Laboratory before the USPTO and non-US patent offices and represent the Laboratory in other activities related to the practice of intellectual property law, including licensing.

- Interpret and apply federal and state laws and regulations and provide legal advice to Laboratory management and staff on all aspects of intellectual property law and technology transfer.

- Review contracts and related documents including support for licensing and other technology transfer activities.

- Draft policies and procedures relating to intellectual property law issues.

- Identify and evaluate inventions, conduct patent searches and draft opinions, perform infringement studies and other evaluations of technology.

- Interact collaboratively with peers, the scientific and technical community at LLNL and outside counsel.

- Assist more experienced counsel in complex or sensitive transactional, managing litigation, arbitration, mediation of disputes related to intellectual property matters, and regulatory matters as requested.

-Act as trusted advisor to senior managers on sensitive matters of policy, sponsor engagement and risk management.

-Perform other duties as assigned.


-Juris doctorate from an ABA accredited law school, and either admitted to practice in California or eligible for a limited practice license as registered in-house counsel.

-BS degree in a technical field, or equivalent combination of education and related work experience. Admission to practice before the US Patent and Trademark Office (USPTO).

-Ten or more years of active legal practice in the area of intellectual property with progressively greater responsibility and experience in writing and prosecuting US and foreign patent applications in some or all of the following fields: biology; optics, lasers, physics, computer sciences; chemistry and materials; mechanical chemical and electrical engineering.

-Advanced analytical, writing, and presentation skills.

-Experience leading and contributing to multi-disciplinary teams.

-Experience applying independent judgment in advising senior managers about legal and reputational risk and tradeoffs between and among possible courses of action.

-Significant experience drafting and negotiating non-disclosure agreements, licenses and other complex contractual agreements, including negotiating settlements, drafting formal and informal legal guidance, and drafting other policy related documents.

-Demonstrated ability to collaborate with other attorneys and non-attorney professionals to work as a team in accomplishing goals and solving problems collectively.

Desired Qualifications

-Knowledge and experience relating to technology transfer, in the commercial or federal sector,

-Knowledge of the Federal Acquisition Regulation and laws and regulations concerning government-owned intellectual property.

-Demonstrated success in supporting multidisciplinary teams tasked with solving complex problems/disputes in an environment implicating the interests of multiple stakeholders.

Pre-Employment Drug Test: External applicant(s) selected for this position will be required to pass a post-offer, pre-employment drug test. This includes testing for use of marijuana as Federal Law applies to us as a Federal Contractor.

Security Clearance: This position requires a Department of Energy (DOE) Q-level clearance.

If you are selected, wewill initiate a Federal background investigation to determine if youmeet eligibility requirements for access to classified information or matter. In addition, all L or Q cleared employees are subject to random drug testing. Q-level clearance requires U.S. citizenship. If you hold multiple citizenships (U.S. and another country), you may be required to renounce your non-U.S. citizenship before a DOE L or Q clearance will be processed/granted.

Note: This is a Career Indefinite position. Lab employees and external candidates may be considered for this position.
